The Ninth Circuit has revised its Model Civil and Criminal Jury Instructions

The Ninth Circuit has posted December 2025 revisions to its civil and criminal Model Jury Instructions.

I have posted a redline/strikeout document showing the changed sections of the civil Instructions.

Changes to the criminal instructions were minor:

  • The Comments to Instructions 2.10 (Other Crimes, Wrongs, or Acts of Defendant) and 3.3 (Other Crimes, Wrongs, or Acts of Defendant) now cite United States v. Boudreau, 154 F.4th 1132 (9th Cir. 2025).

  • The discussions of Rahimi in the Comments to Instruction 14.15 (Firearms—Unlawful Possession (18 U.S.C. § 922(g))) and 14.21 (Firearms—Receipt by Person Under Indictment for Felony (18 U.S.C. § 922(n))) have been rewritten to note United States v. Stennerson, 150 F.4th 1276 (9th Cir. 2025).
